§ 16.52.040. Antennas and satellite dishes.

    Purpose and Intent. The purpose of this section is to mitigate the potential safety, aesthetic, and view blockage impacts of satellite dishes, and to integrate such structures into neighborhoods with the least impact to the surrounding community.

    1.

    Applicability. This section applies to every antenna and satellite dish installed or modified on or after the effective date of this title. This section does not apply to businesses that sell antenna or satellite dishes. No antenna or satellite dish shall be installed or modified without receiving a building permit.

    2.

    Standards for Satellite Dishes in Residential Districts. Every satellite dish shall be installed, modified and maintained in accordance with the standards of this section.

    a.

    A conditional use permit is required for the installation of more than one dish per parcel.

    b.

    A conditional use permit is required for the installation of a dish with a diameter exceeding 2.5 meters.

    c.

    The dish shall not be located in the front or side yards of the parcel.

    d.

    A conditional use permit is required for the placement of a dish that does not comply with all applicable rear year yard setback requirements for accessory structures. The applicant for a conditional use permit must demonstrate that compliance with the provisions of applicable requirements would result in interference or technical infeasibility beyond the control of the applicant.

    e.

    The dish shall be ground-mounted.

    f.

    A conditional use permit is required for the installation of a dish having a height greater than twelve (12) feet above the natural grade. The applicant for a conditional use permit shall demonstrate that compliance with the height restrictions of this section would result in electromagnetic circumstances beyond the control of the applicant.

    g.

    The dish shall be finished in a color to neutralize and blend it with the immediate surroundings.

    h.

    The installation shall be located in such a way as to prevent obstruction of the dish's reception window from potential permitted development on adjoining parcels.

    i.

    The display of signs or any other graphics on a satellite dish is prohibited.

    3.

    Standards for Satellite Dishes in Nonresidential Districts.

    a.

    A conditional use permit is required for the installation of more than one dish per business.

    b.

    A conditional use permit is required for the installation of a dish with a diameter exceeding 3.5 meters.

    c.

    A conditional use permit is required for the placement of a dish that does not comply with all applicable setback requirements for accessory structures. The applicant for a conditional use permit must demonstrate that compliance with the provisions of applicable requirements would result in interference or technical infeasibility beyond the control of the applicant.

    d.

    The dish shall be ground-mounted.

    e.

    A conditional use permit is required for the installation of a dish having a height greater than twelve (12) feet above the natural grade. The applicant for a conditional use permit shall demonstrate that compliance with the height restrictions of this section would result in electromagnetic circumstances beyond the control of the applicant.

    f.

    The dish shall be finished in a color to neutralize and blend it with the immediate surroundings.

    The installation shall be located in such a way as to prevent obstruction of the dish's reception window from potential permitted development on adjoining parcels.

    h.

    The dish shall be screened and landscaped along all sides except that of the reception window. Low-level landscape treatment shall be applied along the dish's base on the reception window side. Such treatments shall completely enclose the dish.

    i.

    The display of signs or any other graphics on a satellite dish is prohibited.

    4.

    Standards for Antennas in All Districts. The installation of one antenna that exceeds the maximum height of the district within which the antenna is to be located shall be permitted subject to the following limitations.

    a.

    Any operation of citizen's band or other radio transmitting equipment, excluding public service, public safety, or emergency radio services shall be subject to the provisions of Chapters 16.48.

    b.

    The antenna shall not exceed ten (10) feet over the height limit for the district in which it is located.

    c.

    The antenna shall not occupy any portion of a required setback, except that a guy wire may be no closer than three feet from a side or rear line.
